วิชานี้มุ่งแนะนำขอบเขตของวิชานิติศาสตร์ หลักทั่วไปของกฎหมาย ระบบกฎหมาย ความหมายและวิวัฒนาการของกฎหมาย หลักพื้นฐานและบ่อเกิดของกฎหมาย ลำดับศักดิ์ของกฎหมาย การแบ่งประเภทของกฎหมาย และการใช้ การตีความ และการอุดช่องว่างกฎหมาย และสาระสำคัญของกฎหมาย รวมทั้งความสัมพันธ์ระหว่างนิติศาสตร์กับศาสตร์สาขาอื่น อีกทั้ง ยังมุ่งศึกษาระบบกฎหมายไทยในเชิงประวัติศาสตร์ด้วย ทั้งนี้ โดยอภิปรายวิวัฒนาการของกฎหมายไทยตั้งแต่สมัยโบราณจนถึงปัจจุบัน โดยเฉพาะตั้งแต่สมัยจัดทำประมวลกฎหมายเป็นต้นมา โดยเน้นในแง่กฎหมายเปรียบเทียบ เพื่อให้เกิดความเข้าใจในระบบกฎหมายไทย
This course aims to introduce the scope of the juridical science, general principles of law, legal systems, meaning and evolution of law, fundamental principles and sources of law, hierarchy of law, classification of law, application and interpretation of law and legal methods for filling lacunae in the law, and essential elements of law and the relationship between the juridical science and other disciplines. The course also explores Thai legal system in a historical context by discussing the evolution of Thai law, from the old times up to the present time, in particular, from the codification period. For this purpose, a comparative-law approach will be pursued in the interest of proper understanding of the Thai legal system.
